Divalicious Delights Bakery Contract Agreement




 A retainer is required to secure your date and order. It is non-refundable and non-transferable. 50% of the invoice shall be paid by the customer within 24 hours from the time it was sent as unpaid invoices will be canceled. After that, a new invoice will be created; however, prices are subject to change. Orders will not be fulfilled if final payment is not received 7 days prior to pickup/delivery.  If the customer changes the original pickup/delivery date, additional fees may apply and prices are subject to change.  We highly recommend placing your order 2-3 weeks in advance to secure your date. There is a $25 rush fee added to orders placed 4-6 days prior to pickup, and a $50 rush fee is added to orders placed 2-3 days prior to pickup/delivery. For next day orders, there is a $75 rush fee added and $100 rush fee added to same day orders.  All rush orders (7 days or less) must be paid in full at the time of order. Minimum order requirement is $150 for all custom orders.  We accept Zelle and Square as methods of payment.




NO REFUNDS. In view of the nature of the service, orders cannot be canceled once confirmed by the company. Retainers and sales are non-refundable and non-transferable.




Changes to your order (size, description, flavors, etc.) will be accepted until 2 weeks prior to the event date. After that lockout date, we cannot accept any changes. No monies will be refunded in the event your order decreases in size or intricacy.




Orders under $150 require 100% payment. A 50% retainer is required when an order is placed (over $150) to confirm the date and start preparations. (This only applies to orders booked 2 or more weeks in advance).  Any remaining balance(s) will be due 7 days prior to pick-up/delivery date, or pthe order will be canceled.  In order to reinstate canceled orders, the late fees are as follows: $25 late fee 4-6 days prior to pickup/delivery, $50 late fee 2-3 days prior to pickup/delivery, and $75 late fee 1 day prior to pickup/delivery.  Payment(s) and/or Electronic Payment(s) through Square, Zelle, or cash validate your signature and agreement to the Terms of Services of this contract.  Securing full or partial payment also confirms that you agree that certain creative changes may be made to your final design for the sake of stability, structural integrity or other certain emergencies.




Tasting appointments may be scheduled for custom cake or dessert table orders that are a minimum of $350. Reservations are taken on a first come first served basis. A $50 non-refundable deposit will secure your date on our calendar or, you may choose a to-go cake tasting for $35. Tastings are reserved for Tuesdays and Wednesdays.




Inspiration pictures are welcomed; however, we do not copy, duplicate, or replicate other cakes and sweet treats. We will incorporate all major themes of cake and sweet treat examples, but we do not create the same exact cake or sweet treat. We make every cake and sweet treat unique to Divalicious Delights, LLC and will not copy another baker’s work. Colors will be interpreted to the best of our ability. If you would like a specific color, please provide a color/fabric swatch instead of a picture. We can guarantee to match the hues within 4 colors (dark/warm) when swatches are provided. Food color reacts differently; therefore, it changes after sitting for more than 6 hours. In addition, photography can make colors appear differently as well. When choosing colors for your desserts, please note that red, maroon, burgundy, purple, dark blue, and black food colorings are bitter. We cannot guarantee photo quality regarding images as it depends heavily on the quality of the picture that is sent to us. It’s possible that an image could print blurry and even warp due to moisture as this is the nature of edible paper.




Our sweet treats are securely packaged. Colorful paper straws, metallic paper straws (gold and silver), bling sticks (gold, silver, and rose gold), and bows are available for an additional fee. All cakes come with a white, gold, or silver basic cake board that fits that particular cake size. For an additional fee, customers may choose a thicker board, wider board, different color board, and add colorful ribbon or bling to the edge of the board.




Our goal is to provide the highest quality food with a delicious taste as our safety standards far exceed the criteria for the local health department, state health department, and FDA. Menu items include milk products (butter, buttermilk, heavy cream, half & half, sour cream, cream cheese, cottage cheese, ricotta cheese, aged cheese, pasteurized cheese, and processed cheese), chocolate, soy, wheat, food coloring (dye), fish and shellfish, tree nuts (coconuts, peanuts, pecans, walnuts, hazelnuts, almonds, pistachios, macadamias), and decorative glitters/dusts (luster dust, disco dust, twinkle dust, sparkle dust, highlighter, shimmer powder, pearl dust, and petal dust). Please inform us if you or anyone you know has food allergies at the time that you place your order.




All orders must be picked up at the scheduled pick-up time. If orders are not picked up in a timely manner, the order may have to be picked up the next day. When transporting your cake, we highly advise placing your cake flat on the floorboard of your vehicle and running your air conditioner. Our delivery fee is $25 minimum for any delivery within a 10 mile radius of our bakery. Deliveries over 10 miles are $2.50 per mile; however, event venue deliveries start at $75 with cake set-up and $50 without cake set-up. Dessert table set-up is not included in delivery; it is an additional $50 per hour. If you do not prepay for delivery on your invoice, your order will not be delivered. It is confirmed that you are satisfied with the presentation of your order upon pickup/delivery. If you have any issues regarding your order during pick-up/delivery, you must let the company know at that time as we are not responsible for product(s) thereafter.


Before serving your cake, store it in a cool place away from bright lights. If you choose to place your buttercream cake in the refrigerator and allow it to come to room temperature, please note that the air can cause condensation which may cause the cake to bleed and melt. Also, fondant cakes may sweat and begin to sag when refrigerated and brought to room temperature. We highly suggest leaving your cake inside the box and placing it in a cool place. Divalicious Delights, LLC is not responsible for weather conditions and the outcome of cakes after leaving Divalicious Delights, LLC.
